5. The agreement
Please read this. It’s what you’re agreeing to, and we keep a copy of exactly this wording with your booking.
PHOTO BOOTH RENTAL AGREEMENT AND CANCELLATION POLICY
This agreement is between Pose & Party LLC ("we", "us") and you, the person making the booking. The details on your booking — the date, venue, package, add-ons and price — are part of it. It becomes binding when you sign below and your deposit is paid.
1. Booking and paying
• A 50% deposit reserves your date. Your date isn't held until it's paid. The deposit is not refundable, because once we hold your date we turn other people away for it.
• The rest is due 30 days before your event. If you book less than 30 days before, the whole amount is due when you book.
• If the balance isn't paid when it's due, we may cancel the booking. That counts as a cancellation by you under section 7.
• Extra time on the night is $100 an hour, if we're able to stay. It has to be agreed in writing — a text or email is fine — and paid before the extra time starts.
• If anything on your bill looks wrong, tell us and give us a chance to put it right.
2. What we provide
• We'll bring and run the package you booked for the hours booked, and take reasonable care setting up, running and packing down.
• If we need to, we may swap equipment, props or materials for something that does the same job just as well.
• Your online photo gallery link is emailed to you after the event. We're not responsible for files lost after they've been delivered to you, or after the gallery has expired.
3. What we need from you and the venue
• Accurate event details, and a contact at the venue who can let us in and sort out access questions.
• The venue's permission for the booth, backdrop, props and power.
• A safe, level, clean spot with enough room for the booth and backdrop, and access to it when we arrive to set up.
• A standard power outlet close to the booth.
• Food, drinks, smoke, open flames and anyone not using the booth kept away from the equipment.
• Outdoor events: a dry, covered spot, protected from rain and direct sun. If the weather puts people or the equipment at risk, we may pause or end the service.
4. Delays and the time you've booked
• If we can't set up or start on time because we weren't given access, power, space or the right information, your finishing time stays the same and there's no refund for the time lost.
• There's no refund for unused booth time, a quiet crowd, an event that ends early, or schedule changes we didn't cause.
5. Looking after the booth
• You're responsible for reasonable supervision of your guests, and for damage, loss or unusual cleaning caused by you, your guests, the venue's staff or other vendors — not for ordinary wear, and not for anything we cause.
• If something is damaged, we'll describe what happened and what it costs to repair, replace or clean, and you can ask to see the evidence.
• We may pause or end the service if there's harassment, violence, drunkenness that makes it unsafe, deliberate misuse, or anything else unsafe. Where we can, we'll give you the chance to sort it out first. If the service ends because of something you or your guests did, there's no refund.
6. Changing your date
• Your first date change is free, as long as you ask at least 30 days before your original date.
• The new date has to be available, and within 12 months of the original.
• If your new date or new choices cost more, you pay the difference.
• If we can't offer a date that works, your request is treated as a cancellation.
7. Cancelling
• Cancel in writing — text or email is fine. The day we receive it is the day that counts.
• The deposit is never refunded.
• 30 days or more before your event: everything you've paid is refunded except the deposit.
• Between 14 and 29 days before your event: half of what you've paid beyond the deposit is refunded.
• Fewer than 14 days before your event, not turning up, or not giving us access to the venue: no refund.
• Refunds go back to the card you paid with, within 7 to 10 business days of being approved. Your bank may take a little longer.
8. If we have to cancel
If we cancel for any reason within our control and can't offer you another date you're happy with, you get everything back, deposit included.
9. If the booth breaks during your event
We'll do everything reasonable to get it working again, including using backup equipment if we have it. If a problem on our side loses you more than 30 minutes in a row and we can't make that time up, we'll refund the share of your booking that was lost. Shorter interruptions, or problems caused by the venue, the power supply, the internet, guests or the weather, don't qualify.
10. Things nobody controls
Neither of us is responsible if severe weather, a natural disaster, a government order, an emergency, the venue closing, or a widespread power or transport failure stops the event. We'll first try to move your booking to another available date within 12 months, and your payments carry over. If that isn't possible, we'll refund what you've paid beyond the deposit, less any costs we can't recover that were spent on your event.
11. Photos
• Your guests will take photos, videos and GIFs in the booth. Please let them know it's there, and check with the venue if they have rules about it.
• We may use a few photos from your event on our website and social media, never with guests' names. If you'd rather we didn't, tell us in writing before your event and we won't. It doesn't change your price.
• If a guest asks us directly not to use a photo of them, we won't.
12. Limits
• If something goes wrong, the most we'll ever owe you is what you paid us for your booking.
• Neither of us is responsible to the other for indirect losses, like lost profits.
• If you have a concern about the service, please tell us in writing within 14 days of the event so we can look into it properly.
13. The rest
• Any change to this agreement has to be in writing and agreed by both of us. Text or email counts.
• This agreement, your booking details and any written changes are the whole agreement between us.
• If any part of it can't be enforced, the rest still applies.
• It's governed by the laws of the State of Oklahoma.
14. Signing
Ticking the box and typing your name on the booking page is your signature, and means you've read and agree to this. We keep a copy of this exact wording with your booking, so it can't change after you've signed.
